Legal basis
- Crisis or armed conflict time
Within the Act No 137/2006 Coll., on Public Contracts, there is included a special legal rule – Act No 241/2000 Coll., on Emergency Economic Measures for Crisis Situations, that addresses the Security of Supply during states of emergency and states of war. There is also the Ordinance No. 498/2000 Coll., on planning and implementation of emergency economics.
- Urgent reasons (i.e. operational reasons)
For urgent reasons (non-military crisis states) we have the Act No 240/2000 Coll., on crisis management (crisis law), which regulates the activity of critical entities.
- Mergers-Acquisitions
There is no special legislation. Association of Defence and Security Industry of the Czech Republic (DSIA CR) has a partial role in coordinating of national defence industry.
- Foreign investments
No. In general terms there are only bilateral intergovernmental agreements related to foreign investment.
- Export licenses
In the Czech Republic the national control system for export and import of conventional arms and military equipment is regulated by Act No. 38/1994 Coll., on Foreign Trade with Military Material. The permit or the license is issued by the Ministry of Industry and Trade of the the Czech Republic.
- Codes/Regulations involving Defence Industry
Act No 241/2000 Coll., on Emergency Economic Measures for Crisis Situations involves partialy charge to Defence Industry. Provider of SoS of this act shall mean an individual with a place of residence or a corporate entity with its registered office in the Czech Republic and an organizational constituent of a corporate entity with its registered office outside the Czech Republic which conducts business in the Czech Republic, with the subject of enterprise or business including activities enabling the provision of necessary supplies or capable of providing such necessary supplies.

- Other?
Objectives of the national SoS policy
The acquisition of state material reserves and their using provides the Government of the Czech Republic. The state material reserve involves selected primary raw materials, materials, semiproducts and products, designated for supporting national defence capability, for consequence management efforts following emergencies as well as for the protection of vital national economic interests.
National bodies involved and areas of responsibilities
The Administration of State Material Reserves is a central government agency in the sphere of economic measures for emergencies, oil security and the state material reserve.
The role of SoS in Procurement procedures (requirements, evaluation etc.)
Procurement procedures to ensure SoS standards are autonomous procurement procedures providing for the delivery of the MoD for all activities of all parts of the MoD including support units, which are in foreign missions. In the future assume greater coherence between both types of procurement processes (ensuring SoS and standard procurement).
SoS requirements are defined in the tender documents. The evaluation criteria specified by the Act No 137/2006 Coll., on Public Contracts. The main evaluation criteria include a minimum bid price, guarantee the quality of goods, operating costs, performance, etc.
Contractual terms on SoS
Responsibilities of suppliers are established by Act No 241/2000 Coll., on Emergency Economic Measures for Crisis Situations, the Ordinance No. 498/2000 Coll., on planning and implementation of emergency economics, and specified in the contract.
National policy on sharing information on stocks/inventories
We share information with the NATO member countries at the mutual agreed level.
Existing Bi/Multi-lateral SoS agreements
Yes, they do exist. The Czech Republic as a member of NSPA, NCIA and other agencies can use services of these organizations. There are also two bilateral cooperation agreements within NSIP domain with the Hungary.
Agreement between Czech MoD and US DOD on acquisition and mutual providing of services.
Bilateral agreements with Slovakia and Germany on emergency strategic oil stockpiling.
